These Terms of Service (“Terms”) govern your access to and use of the Viralscope website, applications, and related services (collectively, the “Service”). The Service is operated by Ember Ventures Ltd., a corporation organized under the laws of British Columbia, Canada (“Ember Ventures”, “we”, “us”, or “our”). “You” means the individual or entity using the Service.

By creating an account, clicking “I agree”, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and account

You must be at least 16 years old to use the Service. You agree to provide accurate registration information, to keep your account credentials confidential, and to be responsible for any activity that occurs under your account. We may suspend or terminate accounts that violate these Terms, that we reasonably suspect of fraud, or that pose a security or legal risk.

2. What Viralscope is

Viralscope surfaces cultural and product trends across public social platforms, search data, app stores, and other public sources, and pairs them with derived analyses such as opportunity scores, ranked leaderboards, and operator playbooks. The output is informational and is intended to help operators, creators, and brands prioritize their own time and product decisions.

Not advice. Viralscope does not provide investment, legal, tax, medical, or financial advice. Nothing on the Service should be interpreted as a recommendation to transact in any security, asset, or product. You are responsible for your own decisions and outcomes.

3. Subscriptions, billing, and refunds

Some features of the Service are available only on paid plans. When you subscribe, you authorize us (and our payment processor) to charge the payment method on file for recurring fees at the cadence you selected (for example, monthly or annual) until you cancel. Fees are listed in the currency shown at checkout and are inclusive or exclusive of applicable taxes as indicated.

You can cancel at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period; we do not provide pro-rated refunds for partial periods unless required by applicable law or stated otherwise at the time of purchase.

We may change pricing, plan features, or available add-ons. If the change affects a renewing subscription, we will give you reasonable notice before it takes effect, and you may cancel before the next renewal if you do not wish to continue.

4. Acceptable use

You agree not to:

  • Use the Service to break any law, infringe anyone's rights, harass any person, or distribute malicious code;
  • Resell, sublicense, or redistribute Viralscope data, exports, or playbooks to third parties as a substitute for them subscribing to the Service;
  • Reverse-engineer, scrape at scale, automate large-volume requests, or attempt to bypass authentication, rate limits, or payment controls;
  • Use the Service to build a directly competing product, train competing machine-learning models on our outputs, or replicate our underlying datasets in bulk;
  • Misrepresent your affiliation with Viralscope or Ember Ventures, or impersonate any other user.

We may rate-limit, suspend, or terminate access for any account we reasonably believe is violating this section.

5. Your content

The Service may let you input ideas, descriptions, or other prompts (for example, in custom playbooks or chat). You retain ownership of anything you submit. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to process, transmit, display, and store your input solely to operate, support, and improve the Service.

6. Our content and intellectual property

Viralscope, the Viralscope name and logos, the underlying software, the rankings and scores we calculate, the playbook text we generate, the design and look-and-feel of the Service, and all related materials are owned by Ember Ventures or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Service for your internal use during the term of your subscription.

7. Third-party services and sources

The Service incorporates or links to data and services from third parties (for example, social platforms, payment processors, app-store data providers, and AI models). We do not control, and are not responsible for, the accuracy or availability of third-party data or services. Trends, scores, and revenue estimates derived from third-party sources are best-effort approximations and may be wrong or out of date.

8. AI-generated output

Parts of the Service (including playbooks, summaries, and chat replies) are generated by AI models. AI output can be wrong, biased, or made-up. You must independently verify anything important before relying on it, especially numbers, names, claims about third parties, and any tactical guidance that affects spending or legal compliance.

9. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access (with or without notice) if you violate these Terms, if your continued use poses a legal or security risk, or if we discontinue the Service. On termination, your access ends and any paid subscription stops renewing.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, EMBER VENTURES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMBER VENTURES AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU PAID NOTHING, ONE HUNDRED CANADIAN DOLLARS).

13. Indemnification

You will indemnify and hold Ember Ventures harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service in violation of these Terms, your content, or your violation of any third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia, Canada and the applicable federal laws of Canada, without regard to conflict-of-laws rules. The courts located in Vancouver, British Columbia have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

15. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the “Last updated” date and, where appropriate, give you additional notice (for example, by email or via a prominent in-product banner). Continued use of the Service after a change takes effect means you accept the updated Terms.
